1. General Provisions
These Terms and Conditions (hereinafter referred to as the "Agreement") govern access to the website plazmo.com, its mobile version, applications, games, betting, promotions, payment functions and other services provided under the PLAZMO brand (hereinafter referred to as the "Services").
The Services are provided by PLAZMO Entertainment Ltd (prototype), Company No. [placeholder], registered at [Registered address in the EU — placeholder] (hereinafter referred to as "PLAZMO", "Company", "we", "us" or "our").
PLAZMO operates through the domain plazmo.com under Licence No. PLZ-EU-0000 (prototype placeholder), issued and supervised by [Regulator — to be confirmed]. The existence of a license does not override or replace the requirements of local law applicable to the player at their place of actual residence.
By registering an account, using the Services or placing a bet, you confirm that you have read, understood and unconditionally accepted this Agreement. If you do not agree with any provision, you are not entitled to create an account or use the Services.
2. Documents Constituting Part of the Agreement
This Agreement also includes the following documents:
- Privacy Policy;
- Cookie Policy;
- Responsible Gaming Policy;
- AML and KYC Policy;
- Bonus and Promotional Terms;
- Individual Game Rules, Payout Tables and Instructions;
- Special Terms displayed prior to participation in a promotion or placement of a bet.
In the event of any conflict between this Agreement and the special rules, the special rules shall prevail, but only with respect to the relevant game, bet or promotion.
3. Player Requirements
A PLAZMO account may only be created and used by a person who simultaneously meets all of the following conditions:
- Has reached the age of 18 (or the higher minimum age for gambling established by the laws of the country of actual residence);
- Has full legal capacity to enter into a legally binding agreement;
- Participation in online gambling is not prohibited by the laws of the country of actual residence, presence or citizenship;
- Is not located in a jurisdiction included in the list of prohibited jurisdictions (Section 4);
- Is not subject to self-exclusion, a court order or any other restriction on gambling participation;
- The information provided during registration is complete, accurate and up to date;
- Acts solely in their own name and not on behalf of a third party or in the interests of another person.
The player is solely responsible for verifying that the use of the Services complies with the laws of their country, province, state or other applicable jurisdiction. PLAZMO does not advise players on matters of applicable local law.
PLAZMO reserves the right to request proof of age, identity, address and actual location at any time. If a minor or a person who does not meet the requirements is identified, the account will be blocked, deposits will be returned (without winnings), and information about the violation may be reported to the competent authorities.
4. Prohibited Territories
The Services are not available to persons located, residing or holding citizenship in the following countries and territories where online casinos are prohibited or require a local license that PLAZMO does not hold:
- United States of America (all states and territories without exception);
- Australia;
- China, including Hong Kong and Macau;
- Japan;
- Singapore;
- South Korea;
- Thailand;
- Vietnam, Cambodia, Laos, Myanmar;
- Indonesia, Malaysia, Brunei;
- Bangladesh, Bhutan, Maldives, Nepal;
- India;
- Pakistan, Afghanistan;
- United Arab Emirates, Saudi Arabia, Qatar, Kuwait, Bahrain, Oman;
- Iran, Iraq, Yemen, Syria, Jordan, Lebanon, Israel;
- North Korea;
- Turkmenistan, Uzbekistan, Tajikistan;
- Cuba;
- Albania, Iceland;
- New Zealand;
- United Kingdom, Switzerland;
- EU and EEA countries whose national law requires a local licence that PLAZMO does not hold. Placeholder for the prototype: the country list follows the EU licence and is set before launch.
- Colombia;
- Chile;
- Any other jurisdiction where the provision of online gambling is prohibited or requires a local license that PLAZMO does not hold.
PLAZMO uses location detection technologies (IP analysis, geolocation, registration data) to monitor compliance with territorial restrictions. PLAZMO reserves the right to supplement or modify the list of prohibited jurisdictions at any time without prior notice. The current list is published on the website plazmo.com.
The use of VPNs, proxy servers, false addresses, location concealment technologies or any other means to circumvent territorial restrictions is prohibited. If such actions are detected, the account will be immediately blocked, funds will be confiscated and winnings will be annulled without the right to a refund.
5. Account Registration
Each player is entitled to have only one personal PLAZMO account. Creating multiple accounts by one person (multi-accounting) is prohibited and constitutes a material breach of this Agreement.
During registration, the following current and accurate information must be provided:
- full name (as shown on the identity document);
- date of birth;
- address of actual residence;
- valid email address;
- mobile phone number;
- other information reasonably requested by PLAZMO.
If the provided information changes, the player must promptly update it in their account. PLAZMO reserves the right to temporarily restrict account functionality until outdated or contradictory information is corrected.
The account is strictly personal. It is prohibited to sell, transfer, lease, share or otherwise allow another person to use the account.
The use of a shared device, home address or internet connection is not in itself a violation. However, PLAZMO reserves the right to conduct additional verification if multiple accounts are linked or if there are reasonable signs of fraud, collusion or bonus abuse.
6. Identification, KYC and AML Checks
PLAZMO is required to verify the identity of players, take measures to prevent money laundering and combat fraud. KYC verification is a mandatory condition for withdrawals.
PLAZMO may request the following documents and information:
- Identity document (passport, ID card, driver’s license);
- Proof of address (utility bill, bank statement, tax notice — not older than 3 months);
- Proof of age;
- Proof of ownership of the payment method (photo of card with masked digits, screenshot of e-wallet, statement);
- Source of Funds information when total deposits exceed €10 000;
- Photograph, selfie with document or video verification;
- Explanations regarding individual deposits, withdrawals or other suspicious account activity.
Documents must be valid, legible, genuine and belong to the account owner. Providing false, altered, stolen or misleading documents constitutes a material breach, resulting in immediate account blocking and confiscation of all funds without the right to a refund.
Until the necessary checks are completed, PLAZMO may apply proportionate restrictions: freeze deposits, bets, bonuses or withdrawals. Withdrawals may be delayed for an indefinite period if additional verification or investigation is required.
Where there is a legal basis, PLAZMO may report suspicions of fraud, money laundering, terrorist financing or other unlawful activity to the competent authorities. The law may prohibit the Company from informing the player that such a report has been made.
7. Account Security
The player bears full responsibility for maintaining the confidentiality of their login, password, PIN code, two-factor authentication data and other credentials.
The player must immediately notify PLAZMO at security@plazmo.com if:
- Another person has gained access to the account;
- The password or device may have been compromised;
- A transaction was made without the player’s authorization;
- The registered email or phone number is no longer secure.
PLAZMO may temporarily restrict the account during the investigation of a security incident. Restoration of access may require a password change or additional verification.
PLAZMO never requests a full password, CVV code, full card number or cryptocurrency wallet private keys via email, messengers or social networks. Any such request is fraudulent, and the player must immediately report it to customer support.
8. Deposits
Deposits must be made using a payment method belonging to the account owner. The use of third-party payment details is prohibited and constitutes fraud.
Available payment methods, currencies, limits, fees and estimated processing times are displayed in the Cashier prior to confirming the transaction. PLAZMO reserves the right to change the list of available methods without prior notice.
A deposit may be declined, returned or sent for additional review if:
- The payment details do not match the account owner’s information;
- The transaction is incomplete or cannot be confirmed by the payment provider;
- The operation creates a legal, regulatory or fraud risk;
- The payment method belongs to a prohibited jurisdiction;
- There are signs of money laundering or transaction structuring.
Making a deposit does not guarantee the ability to withdraw it immediately. PLAZMO may pre-verify the player’s identity, ownership of the payment method and the legitimacy of the transaction origin. A PLAZMO account is not a bank account and must not be used for money transfers, currency exchange, cryptocurrency exchange or investment activities.
9. Withdrawals, Timeframes, Limits and Fees
Withdrawal of the available cash balance is possible through the Cashier subject to the following mandatory conditions:
- Full KYC verification has been successfully completed (identification, payment method verification);
- The daily withdrawal limit of the player’s VIP level is observed (see 9.2);
- There are no unsettled bets, unconfirmed transactions or active bonus obligations;
- All necessary AML and antifraud checks have been completed;
- There are no legal, regulatory or internal restrictions on the account.
9.1. Withdrawal Processing Timeframes
PLAZMO endeavors to process fully submitted withdrawal requests within the processing time of the player’s VIP level (see 9.2), counted from the receipt of all requested documents and information. This timeframe is indicative and not a binding obligation. During periods of high load, technical maintenance or when additional checks are required, the processing time may be extended without prior notice.
The crediting time to the payment instrument depends on the chosen method: e-wallets (Skrill, Neteller) — up to 24 hours; bank cards (Visa, Mastercard, including Apple Pay and Google Pay) — 1 to 3 banking days; SEPA bank transfers — 1 to 3 banking days; Trustly — near-instant; cryptocurrency — up to 1 hour. These timeframes are beyond PLAZMO’s direct control.
9.2. Withdrawal Limits
Full verification decides whether a player can withdraw: until it is complete, withdrawals are closed. The player’s VIP level (see the VIP club page) decides how much can be withdrawn per day and how fast PLAZMO processes the request:
| VIP level | Daily limit | Processing |
|---|---|---|
| Spark | €2 000 | 24–72 hours |
| Ember | €3 000 | 24–72 hours |
| Flare | €5 000 | 24 hours |
| Core | €10 000 | 12 hours |
| Plasma | €25 000 | 2 hours |
Withdrawals completed before 28.09.2026 followed the previous rule, under which an account with a confirmed e-mail could withdraw up to €2 000 in total before full verification; that rule no longer applies. The minimum withdrawal amount is €20 (twenty). The minimum deposit is €10 (ten) for every method; crypto deposits are counted at their EUR equivalent. PLAZMO reserves the right to set individual limits for a particular player without giving reasons. In the event of a progressive jackpot win, payment may be made in instalments over 12 months at PLAZMO’s discretion.
9.3. Fees
PLAZMO does not charge a fee for processing a standard withdrawal. However, fees may be deducted in the following cases:
- By the payment provider, bank or cryptocurrency network — in the amount set by the third party;
- On conversion of cryptocurrency or a non-EUR payment into EUR — at the payment system rate or at the market rate with a margin of up to 3%;
- On withdrawal to details that do not match the deposit method (where reverse withdrawal is not possible) — in the amount of the direct processing costs, but no more than 5% of the amount;
All fees are displayed in the withdrawal interface before the transaction is confirmed. The player must review the total amount to be credited before confirming the operation.
9.4. Withdrawal Procedure
Withdrawals are available only to a payment instrument registered in the name of the account owner. Withdrawal to third-party details is strictly prohibited and constitutes fraud.
Where possible, funds are withdrawn to the same payment method that was used for the deposit (reverse withdrawal rule). PLAZMO may request another verified withdrawal method if the original method does not support withdrawals or if its use is impossible for security reasons.
9.5. Cancellation and Rejection of a Withdrawal
Until the funds are actually sent, the player may cancel the withdrawal request through the personal cabinet. Once processed, a withdrawal is irreversible.
PLAZMO may reject or suspend a withdrawal in the following cases:
- Verification is incomplete or has raised questions;
- There is an active bonus with unfulfilled wagering requirements;
- Suspicion of fraud, multi-accounting, bonus abuse or collusion;
- Breach of this Agreement by the player;
- Technical failures, force majeure or requirements of the competent authorities;
- The requested withdrawal amount exceeds the established limit — in this case the player may resubmit a request for an amount within the limit.
If a withdrawal is rejected, PLAZMO will state the reason through the personal cabinet or by email, except where disclosure of such information is prohibited by law or may impede an investigation.
10. Currencies and Cryptocurrency Transactions
The account currency is the euro (EUR). It is set at registration and cannot be changed. Cryptocurrency (BTC, ETH, USDT) is accepted as a payment method only and is credited and paid out at its EUR equivalent. If conversion is required to carry out a transaction, the applicable rate and any fee are displayed or explained before the operation is confirmed.
Crediting a cryptocurrency transaction may require a certain number of blockchain confirmations. PLAZMO does not control blockchain network fees, network congestion, changes in the value of cryptocurrency, the processing of a transaction by a third-party wallet or exchange, or the consequences of specifying an incorrect address or network.
Before confirming a transaction, the player must check the wallet address, the selected network and the type of cryptocurrency. Transactions sent to an incorrect address or through an incompatible network are irreversible. PLAZMO is not responsible for the loss of funds resulting from a player’s error when entering payment details.
11. Player Funds
Player funds are accounted for in accordance with PLAZMO’s internal policy. A PLAZMO account is not a bank account, is not insured and does not accrue interest.
The account balance may consist of:
- Real money (deposits, non-bonus winnings);
- Bonus funds (funds credited under promotions and subject to wagering);
- Funds pending withdrawal (frozen while the request is processed);
- Funds relating to unsettled bets.
Each category of funds is indicated in the player’s account. Bonus funds may not be withdrawn until the wagering conditions are met. The deposit balance is available for withdrawal at any time, except where withdrawal is blocked in accordance with this Agreement.
12. Casino Games
Each game is governed by its own rules, payout table and technical information. Before placing a bet, the player must review this information.
PLAZMO provides information on:
- The objective and rules of the game;
- Permitted bet sizes;
- Possible payouts and odds;
- The return to player (RTP) rate;
- Jackpot conditions;
- Special game features and bonus rounds.
Game results are generated or recorded by the game servers of PLAZMO or of certified providers. If the visual animation on the player’s device differs from the result recorded by the server, the server record confirmed by technical logs shall prevail.
13. Errors, Technical Failures and Game Interruption
PLAZMO takes reasonable measures to ensure the accuracy of odds, balances, game information and results. Nevertheless, technical or human errors are occasionally possible.
A technical failure, an incorrect payout table, a duplicate credit, an obviously erroneous odd, an incorrect settlement or any other manifest error does not entitle the player to an unintended benefit. Once an error is confirmed, PLAZMO takes reasonable measures to restore the position of the parties that would have existed had the error not occurred. Such measures may include:
- Correcting the balance (including debiting funds credited in error);
- Re-settling the bet at the correct odds;
- Cancelling the affected transaction;
- Paying the amount actually due to the player.
A minor error that did not affect the outcome is not grounds for confiscating lawfully obtained funds. Any decision must be proportionate and supported by system records.
13.1. Game Interruption and Loss of Connection
If a game is interrupted due to loss of connection, a device failure or a technical fault, the result is determined by the game server record. Upon logging back into the account, an unfinished game may be resumed from the point of interruption or settled automatically according to the server record. If resumption is impossible, the bet is returned to the player and the winnings are annulled. PLAZMO is not responsible for loss of connection on the player’s side (problems with the internet, device or power supply).
14. Bonuses and Promotions
Participation in bonuses and promotions is voluntary. Before a bonus is accepted, PLAZMO provides the material terms of the offer, including:
- Eligibility requirements and the minimum deposit amount;
- Wagering requirements and the contribution of individual games;
- The maximum permitted bet while a bonus is active;
- The validity period of the bonus;
- Withdrawal restrictions and the maximum bonus conversion amount;
- Excluded payment methods, games and territories.
The terms of a promotion already accepted by a player may not be changed retroactively to the player’s detriment, except where the change is required by law or is necessary to correct a genuine technical error.
The following is considered bonus abuse:
- Using linked accounts to claim the same offer repeatedly;
- Manipulating identification data;
- Placing opposing bets (hedging) to guarantee the completion of wagering;
- Exploiting a technical fault;
- Registering multiple accounts to claim a single limited offer;
- Any other action aimed at obtaining an unintended benefit by circumventing the terms of a promotion.
If bonus abuse is detected, PLAZMO may annul the bonus and any related winnings, close the account and confiscate funds obtained as a result of the abuse, without the right to a refund. Using an ordinary playing strategy or winning a large amount is not in itself abuse.
15. Prohibited Actions
Players are strictly prohibited from:
- Using false, stolen or third-party personal and payment data;
- Creating multiple accounts without the written permission of PLAZMO;
- Engaging in fraud, collusion, money laundering or payment manipulation;
- Using bots, scripts, auto-clickers or other unauthorized automated tools;
- Interfering with the operation of PLAZMO’s systems, servers or security mechanisms;
- Knowingly exploiting a technical error, failure or vulnerability;
- Manipulating games, game results or tournament leaderboards;
- Selling, transferring, buying or exchanging PLAZMO accounts;
- Initiating unjustified chargebacks, payment disputes or claims against payment providers;
- Threatening PLAZMO employees, insulting them or other players, or using aggressive, threatening or systematically abusive language in communications;
- Using the Services for unlawful purposes, including terrorist financing;
- Circumventing territorial restrictions, responsible gaming limits or an account block by any means, including VPN, proxy or data substitution.
Before taking a decision, PLAZMO considers the available evidence and the severity and persistence of the violation. Depending on the circumstances, PLAZMO may:
- Reverse a benefit obtained unlawfully;
- Annul the affected transactions and winnings;
- Restrict account functionality (including freezing withdrawals);
- Close the account and confiscate funds obtained as a result of the violation;
- Notify the competent regulatory or law enforcement authorities;
- Add the player to a shared operator stop-list.
16. Account Review and Temporary Blocking
PLAZMO may temporarily restrict an account where this is reasonably necessary in order to:
- Verify identity, age, location or ownership of the payment method;
- Investigate possible fraud or prohibited actions;
- Protect the account against unauthorized access;
- Comply with a requirement of law, a court or a government authority;
- Carry out an AML check or a responsible gaming review;
- Correct a technical or accounting error.
Where permitted by law, PLAZMO states the general reason for the restriction and specifies which documents or information must be provided to have the block lifted. The restriction remains in force for the time reasonably necessary to complete the review. PLAZMO does not guarantee specific timeframes for lifting a block.
Lawful and undisputed funds are not confiscated solely because of a temporary block, provided the player has not breached this Agreement. Where a breach is suspected, withdrawals may be blocked until the investigation is completed, with no time limit.
17. Account Closure
A player may request closure of their account by contacting customer support at support@plazmo.com. Before closure, PLAZMO may require identification and the completion of pending transactions. The balance available for withdrawal is returned via a verified payment method, subject to the requirements of the law.
PLAZMO may close an account immediately if:
- There is evidence of fraud, serious abuse or systematic violations;
- Further provision of the Services would breach the law or license requirements;
- Closure is required by a regulator, a payment provider or a competent court;
- The account creates a material security or AML risk;
- The player has seriously or repeatedly breached this Agreement;
- The player circumvents territorial restrictions or responsible gaming tools.
Where an account is closed on PLAZMO’s initiative in connection with a breach of the Agreement, PLAZMO may withhold amounts obtained by the player as a result of the breach (including bonuses, winnings from bonuses and unlawfully obtained funds). The deposit balance unrelated to the breach is subject to return via a verified payment method, less any applicable fees. Closure of an account does not terminate rights and obligations that arose before the closure date.
18. Inactive Accounts
An account is deemed inactive if the player has not logged in and has not carried out any transactions for 12 (twelve) months.
After 18 (eighteen) months of inactivity, PLAZMO may charge an administrative fee of 5% of the account balance per month, but no more than €50 (fifty) per month. If the balance is below €5 (five), the account may be closed and the remaining balance annulled.
Before the fee is charged, PLAZMO sends advance notice to the registered email address. To prevent the charge, it is sufficient to log in to the account or carry out any transaction.
19. Responsible Gaming (RG Tools)
PLAZMO is intended solely for entertainment. Gambling should not be regarded as a source of regular income or a means of investment. PLAZMO provides the following self-control tools (subject to technical availability):
- Deposit limits (daily, weekly, monthly);
- Bet or loss limits;
- Gaming session duration limits;
- Temporary break (cooling-off) — from 24 hours to 30 days;
- Self-exclusion — from 6 months to indefinite;
- Access to account and transaction history;
- Reality checks (pop-up notifications about time spent playing and amounts wagered).
19.1. How Limits Are Applied
A reduction of limits is applied immediately. An increase or cancellation of limits takes effect after 24–72 hours (cooling-off period). A player may set limits in the personal cabinet or by contacting customer support at rg@plazmo.com.
19.2. Self-Exclusion
A self-exclusion request is applied as soon as reasonably practicable after confirmation. During the self-exclusion period, the player cannot log in to the account, make deposits, place bets or request withdrawals. Self-exclusion cannot be cancelled early. Upon expiry, the player may request reinstatement of access by undergoing re-verification. PLAZMO takes reasonable measures to cease direct marketing communications during self-exclusion.
Circumventing limits or self-exclusion by creating a new account, using different personal data, VPN or other means is prohibited. If circumvention is detected, all accounts are blocked and funds are confiscated.
Players experiencing problems controlling their gambling may seek help from: GamCare (www.gamcare.org.uk), Gamblers Anonymous (www.gamblersanonymous.org), Gambling Therapy (www.gamblingtherapy.org), BeGambleAware (www.begambleaware.org). For responsible gaming enquiries, contact: rg@plazmo.com.
20. Personal Data, Record Keeping and Communications
PLAZMO processes personal data in accordance with the Privacy Policy and applicable data protection requirements.
Where there is a legal basis, information may be transferred to:
- Identity and verification services;
- Payment providers and processing centers;
- Game providers and game data providers;
- Fraud prevention and AML screening systems;
- Professional consultants and auditors;
- Regulatory authorities;
- Government and law enforcement authorities upon request, by court order or on another legal basis.
Records of the account, transactions, verification and communications are retained for 5 (five) years, or for a longer period if required by law, a regulatory authority or an ongoing dispute.
Email, SMS and account notifications are used to convey contractual, technical, regulatory and marketing information. A player may opt out of marketing messages through account settings or the link in the email. Opting out of contractual and technical notifications is not possible.
21. Complaints and Dispute Resolution
If a player believes that an account decision, a payment, a game result, a bonus decision or a bet settlement is incorrect, they must first submit a complaint directly to PLAZMO.
Address for complaints: complaints@plazmo.com
The complaint must state:
- The username or account number;
- The transaction, bet or game session ID;
- The date and time of the event;
- A detailed description of the problem;
- Any supporting materials available (screenshots, correspondence).
PLAZMO acknowledges receipt of a complaint within 5 (five) business days and conducts an objective investigation. The Company endeavors to provide a final response within 30 (thirty) calendar days of receiving all information reasonably necessary for the investigation. Complaints must be submitted without undue delay and no later than 6 (six) months from the date of the event.
PLAZMO is not a member of an independent ADR scheme. If a dispute is not resolved under the internal procedure, the parties refer it for consideration in accordance with Section 29 of this Agreement. PLAZMO does not guarantee a favourable outcome for any complaint and reserves the right to make final decisions on disputed situations on the basis of internal data and logs.
22. Intellectual Property
The PLAZMO brand, the website design, software, texts, images, interfaces, databases and other elements belong to PLAZMO or are used under the relevant license.
The player is granted a limited, personal, revocable and non-transferable right to use the Services solely for lawful personal entertainment purposes. Without the written permission of PLAZMO, it is prohibited to copy, distribute, sell or modify the software, carry out reverse engineering, collect data automatically or use PLAZMO content for commercial purposes.
23. Third-Party Services
Certain games, payment methods, verification services and technical functions are provided by third-party organizations. PLAZMO remains responsible to players within the limits established by this Agreement and applicable law. Processing times of third-party services, network failures and the availability of external systems may be beyond PLAZMO’s direct control.
Links to third-party websites are provided for convenience and do not imply endorsement of all materials or services of such websites. PLAZMO is not responsible for the content, privacy policies or actions of third-party websites.
24. Taxes
The player independently determines whether taxes, levies and reporting obligations apply to their deposits, withdrawals or winnings. PLAZMO is not the player’s tax agent and does not provide tax advice. PLAZMO may withhold taxes, disclose information or take other mandatory actions where expressly required by applicable law.
If a player is unsure of their tax obligations, it is recommended that they consult an independent tax specialist. PLAZMO is not responsible for the tax consequences of using the Services.
25. Service Availability and Force Majeure
PLAZMO may temporarily suspend all or part of the Services for maintenance, updates, security or to comply with regulatory requirements. Where possible, large-scale planned work is announced in advance through the website or by email.
PLAZMO is not responsible for a delay in or failure to perform its obligations caused by:
- Large-scale network failures and DDoS attacks;
- Natural disasters;
- Military action, terrorism, civil unrest;
- Decisions of government authorities, sanctions, embargoes;
- Failures of external payment systems or blockchain networks;
- Large-scale cyber incidents or third-party breaches.
This Section does not exclude obligations that cannot be excluded under applicable law.
26. Limitation of Liability
Nothing in this Agreement excludes or limits PLAZMO’s liability for: fraud; wilful misconduct; gross negligence; death or personal injury caused by negligence; or any other liability that cannot be excluded by law.
Subject to those exclusions, PLAZMO is liable only for direct and reasonably foreseeable loss arising from a proven breach by the Company of this Agreement. PLAZMO’s maximum liability under any claim is limited to the amount of the player’s deposits over the last 6 (six) months, and in any event to no more than €10 000 (ten thousand).
PLAZMO is not liable for:
- Indirect, incidental, punitive or presumed losses;
- Loss of profit or lost commercial opportunities;
- The consequences of the player’s own unlawful actions;
- The consequences of the player providing incorrect or incomplete information;
- Use by third parties of compromised login credentials (where the player did not report the compromise);
- Sending funds to an incorrect payment address or an incompatible blockchain network through the player’s fault;
- Changes in cryptocurrency rates, blockchain network delays or the actions of payment providers;
- Any losses exceeding the amount of deposits made by the player at the time the loss arose.
This Section does not limit the player’s right to receive lawful funds and winnings obtained in accordance with this Agreement where the player has committed no breach.
27. Amendments to the Agreement
PLAZMO may update this Agreement where there is a reasonable need connected with:
- Changes in legislation or license requirements;
- The addition or discontinuation of individual Services;
- Developments in technology and security mechanisms;
- Changes in fraud prevention methods;
- A change of payment or game providers;
- The need to improve the clarity of the text or correct an error.
The updated version and its effective date are published on the website plazmo.com. Players are notified of material changes by email or through the personal cabinet where reasonably possible. Continued use of the Services after publication of the changes constitutes unconditional acceptance of the new version of the Agreement. If a player does not agree with the changes, they must stop using the Services and close their account. Changes do not apply retroactively to cancel a right that has already arisen on the basis of a correct and completed transaction, except where required by law.
28. Language of Documents
This Agreement is published in English. Translations into other European languages may be added later; in the event of any discrepancy between the translations, the English version shall prevail. Translations must accurately convey the content of the English document and may not be used to diminish the lawful rights of the player. If a player does not understand a provision of the Agreement, they must contact customer support at support@plazmo.com before making a deposit or placing a bet.
29. Governing Law and Dispute Resolution
29.1. Governing Law
This Agreement and all relations between the player and PLAZMO are governed by the laws of [the EU member state of the licence, placeholder], without regard to conflict of law rules. If the player’s mandatory local law provides a higher level of consumer protection that cannot be excluded by contract, such rules apply to the minimum extent necessary.
29.2. Pre-Action Procedure
Before applying to a court or arbitration, the player must send a written claim to PLAZMO customer support at complaints@plazmo.com. PLAZMO considers the claim within 30 (thirty) calendar days of receiving all necessary documents. If the claim is not resolved within that period, the dispute is referred for consideration in the manner established by this Section.
29.3. Arbitration
Any disputes, disagreements or claims arising out of or in connection with this Agreement, including questions of its validity, interpretation, performance or termination, shall be finally resolved by arbitration in accordance with the Rules of the Arbitration Institute of the Stockholm Chamber of Commerce (SCC Rules). The seat of arbitration is Stockholm, Sweden. The arbitral tribunal shall consist of one (1) arbitrator. The language of the arbitration is English. The arbitral award is final, binding and not subject to appeal.
29.4. Class Action Waiver
The player acknowledges and agrees that any disputes with PLAZMO are resolved solely on an individual basis. The player waives the right to participate in class actions, class arbitrations or any other joint court or arbitration proceedings against PLAZMO. The arbitrator may not consolidate the claims of several players or hear them jointly. If any court or competent authority finds this clause invalid, the remaining provisions of this Section continue to apply in full.
29.5. Jurisdiction
In cases where a dispute by its nature cannot be referred to arbitration (including claims for interim relief), the parties agree to the jurisdiction of the competent courts of [the EU member state of the licence, placeholder]. The player confirms that they will not initiate legal proceedings in other jurisdictions in respect of disputes governed by this Agreement.
30. Final Provisions
If any provision of the Agreement is found invalid or unenforceable by a competent court or arbitration, the remaining provisions continue to apply in full. The invalid provision is replaced by a valid provision that is as close as possible in meaning to the original.
If PLAZMO has not exercised any right immediately, this does not constitute a waiver of that right and does not deprive PLAZMO of the right to exercise it in the future.
The player may not transfer the account or any rights or obligations under this Agreement to a third party without the written consent of PLAZMO.
PLAZMO may transfer its rights or obligations as part of a lawful corporate reorganization, sale of business or regulatory procedure, provided that players’ rights are not materially diminished.
This Agreement and the documents listed in Section 2 constitute the entire agreement between the player and PLAZMO. Provisions which by their nature are intended to continue in force after account closure shall survive. In particular, this applies to the provisions on checks, payments, intellectual property, complaints, liability and dispute resolution.
